What is a Divorce Law?

Typically, there are the three types of divorce which are no-fault, fault and summary divorce. A no-fault divorce involves none of the partner contends the reasons for a divorce.

       

Both the partners consent for a divorce without blaming either of them. Almost all states allow no-fault divorces these days.

A fault divorce comprises a partner blaming his or her partner for reasons such as adultery, physical or mental abuse, attempted murder, drug use or impotency. Such cases have influence on the property division and child custody as well. Whereas, a summary divorce is the most trouble-free divorce wherein the couple has no children and little possessions are in conflict. Summary divorce is considered to be easier because it involves less paperwork, fewer court appearances, and easy negotiations.

While divorce may be in the interest of both the partners but it influences the children the most. Hence, always try to work out things prior to applying for divorce and make best arrangement for your children. Always consult a qualified divorce lawyer to help you to arbitrate a good working arrangement. If both partners fail to settle down with the custody of their children and their arrangements, the court has the authority to take decisions in the child's best interest.
